As a best practice, and unless the law of the receiving jurisdiction already provides adequate protection of transfers of biometric data between jurisdictions, the system operator should take reasonable steps to ensure that the data transferred continues to be adequately protected, such as by following model contracts for the transfer of personal data such as those offered by the Article 26 (4) of directive 95/46/EC Data Protection Working Party of the European Commission 3) , even though this may not be a legal requirement in the jurisdictions in which the organization operates.
